People South’s most recent Action Group meeting explored the next stage of implementing the Employment Rights Act, focusing on third-party sexual harassment, which comes into effect on 30th October 2026.
New Chair of People South Darren Tibble, Partner and Head of Employment Law at Dutton Gregory, provided an overview of the changes to the Employment Rights Act relating to third-party sexual harassment and what Champions need to know, including the proactive steps organisations need to take to prevent harassment from third parties, including customers, clients, contractors and other individuals’ employees may encounter through their work.
Darren highlighted the importance of understanding where these risks exist, ensuring appropriate standards and reporting routes are in place, and being able to evidence the steps an organisation has taken to prevent and respond to incidents.
Jo Morgan, CEO of Engendering Change, who is developing a white paper on professional judgement and a new framework for behavioural assurance in construction and housing, shared case studies from her research on behavioural risk and professional standards. She highlighted the importance of looking beyond policies and training to understand how workplace culture and behaviours are experienced in practice.
Jo discussed how issues such as inappropriate banter, blurred professional boundaries, workplace social events and interactions with third parties can create risks for organisations. She also highlighted the importance of engaging leaders and the wider workforce in creating a culture where concerns are recognised and addressed.
The next People South meeting will take place on 2 December at Portsmouth Guildhall, with employment law barrister Barnaby Large joining the group to provide his expert insight into the next stage of the Employment Rights Act, including changes relating to unfair dismissal.
We also have to say goodbye to Heidi Roper, who has stepped down as Co-Chair of People South. Heidi’s dedication and hard work supporting the Action Group has been invaluable, and we wish her all the best for the future.
